Old Lyme Board of Selectmen
Regular Meeting October 7, 2002

The Board of Selectmen held its regular meeting at 4:00 P.M. on Monday, October 7, 2002 at Memorial Town Hall Auditorium.  Those present were First Selectman Timothy Griswold, Selectman Tom Bice and Selectman Skip Sibley.

Special Breast Cancer Awareness Presentation by Dr. Vijay Sikand, Health Director, Nancy Stark, Program Coordinator and Barbara DeFronzo, breast cancer survivor. Nancy Stark, a breast cancer survivor, informed the public that breast cancer related literature is available at the Old Lyme Library for the month of October.  Also, Nanette Thomas, R.N. at the Lawrence Memorial Hospital will be a guest speaker on Tuesday, October 22, 2002 at 7:00 P.M. in the community room at the library.

Barbara DeFronzo, a breast cancer survivor, mentioned a program called Reach to Recovery in which women who are breast cancer survivors volunteer their services by visiting other women with breast cancer to offer support during their crisis.

Dr. Vijay Sikand stated that health is a very important part of town government and he commended the board for inviting him to speak on breast cancer awareness.  He stressed mammography, annual exam by a physician, and self-examination are essential for early detection.  

First Selectman Griswold read a proclamation for National Breast Cancer Awareness Month for 2002.

1.  Approval of Minutes: Special Meeting September 12, 2002 and Regular Meeting
     September 16, 2002.
Selectman Sibley made a motion to approve the minutes of Special September 12, 2002 and September 16, 2002 as presented. Selectman Bice seconded the motion. SO VOTED.

2.  Communications:
a.  Letters of Thanks to Ben Coniff, Dayton Dell, Cory Lomas and Dane Pfeiffer for
     Helping with the Household Hazardous Waste Collection Day
On September 14, 2002 the town held a Household Hazardous Waste Collection Day.  Thank you letters will be mailed to high school students Ben Coniff, Dayton Dell, Cory Lomas and Dane Pfeiffer who inventoried the incoming materials.  They are members of the Green Crew.  

3.  Appointments
a.  Resignation of Doug Tolderlund from the Conservation Commission
Doug Tolderlund has resigned from the Conservation Commission due to health reasons.

b.  Francis Balboni (R) – Lymes Senior Center – 3 year Term to July 2004
The Senior Center Board has recommended Frank Balboni be nominated as a replacement to fill a vacancy on the Senior Center Board.  The opening is a three-year term ending July 2004.  It was decided that First Selectman Griswold would speak with the Senior Center Board to see if all those who have expressed an interest in being on the board have had a chance to be interviewed.

4.  Old Business:
a.  Special Town Meeting on October 21, 2002 at Middle School Auditorium to Consider the Purchase of the Fairfax Properties
In a previous board meeting, it was discussed that the State of Connecticut has approved a grant for the acquisition of two parcels of the Fairfax properties.  One is 64 ½ acres on the north side of the Old Lyme Inn and the other is 204 acres on the south side of I-95 which stretches near Library Lane, Meetinghouse Lane and Whippoorwill Road.  First Selectman Griswold read a proposed call of the Special Town Meeting, which will be held on October 21, 2002 at 7:30 P.M. in the Middle School Auditorium to act upon the following:  
   1.  To authorize the expenditure of a sum not to exceed $418,000 from the Land
        Acquisition Fund toward the purchase from Fairfax Property Inc. of 64 ½ acres
       of land located at 91 Lyme Street and 204 acres of land located at 245 Whippoorwill
       Road contingent upon a grant from the State of Connecticut in the amount of
        $591,956 and $291,506 from the Nature Conservancy for a total purchase price of
       $1,301,000 as recommended by the Board of Selectmen, the Board of Finance,
        the Planning Commission and the Conservation Commission.

  2.  To authorize the transfer of $200,000 from the town’s undesignated surplus to be
        deposited to the town’s Land Acquisition Fund in order to facilitate the Fairfax
       purchase and to provide a balance for future open space acquisitions.
  
Selectman Sibley made a motion to accept the proposed call as read.  Selectman Bice seconded the motion.  SO VOTED.

b.   Shoreline Sanitation – Approve Refuse Container Proposal and Approve Four       
      Year Contract Interval
First Selectman Griswold stated, before reading a resolution, that the Board of Finance voted unanimously to accept the matter of the refuse containers, the cash flow projections and a four-year contract term.  The proposed resolution is the following:
     The Board of Selectmen of the Town of Old Lyme approve the proposal dated
      September 16, 2002 from Shoreline Sanitation, the town’s refuse contractor, to
     implement the automated refuse system as detailed in Shoreline’s proposal.  The
     proposal calls for Shoreline to retrofit one refuse truck with an automated arm and
     to place an order for a new truck that will be equipped with an automated arm.  The
     proposal also calls for the purchase by the town of a sufficient number of three sizes
     of refuse containers that will be issued one to each household in town at no cost to
      the homeowner during the first two quarters of 2003.  Further, it is resolved that the
    contract term between Shoreline and the town be extended to a four-year term which
    will be more compatible with the four-year financing terms of Shoreline.  The Board  
     of Finance has approved Shoreline’s proposal and the four-year contract term at its
     meeting on September 17, 2002.

Selectman Sibley made a motion to accept the proposal as read.  Selectman Bice seconded the motion.  

Selectman Sibley questioned whether there had been responses to the Selectman’s letter sent out in the fall asking for feedback on this matter.  First Selectman Griswold answered that there were 20 – 30 responses.  For those who have special needs, it will be necessary for the Board to address those concerns.  

Selectman Bice asked who would be responsible for the administrative arrangements such as keeping track of which size can each household will receive, identification numbers, and someone responsible for lost, stolen or damaged cans.  Shoreline Sanitation President Gary Yuknat responded that Shoreline Sanitation and the town will have duplicate CD-ROM’s of the cans and the assignments. Gary stated he thought it would be Shoreline’s responsibility for the set up and delivery of the cans and the numbers coinciding with the addresses.                                                                                                                          

First Selectman Griswold stated the contract agreement between the town and Shoreline Sanitation should be amended to reflect who is responsible for what. It must also be made clear to the homeowner that they have responsibility to safeguard the can.

First Selectman Griswold called for a vote on the acceptance of the motion.  SO VOTED.
c.  Town Woods Park - Update    
Lyme and Old Lyme have submitted STEAP grants.  Sen. Melodie Peters sent another letter of support for the new application.  Vollmer Associates presented an application to the Conservation Commission. There will be a site walk and a public hearing at the next Conservation Commission meeting.  
Selectman Bice stated that the Senior Center Board would like the option of a second entrance.  

d.  Sound View Task Force – Update
Selectman Bice reported that Task Force has overwhelming voted to have the town consider purchase the beachfront properties as either open space or for the use of a community center.  
Open Space Committee Chairman George James stated he would like to make the effort to apply for a grant from the State of Connecticut for the purchase of the property. First Selectman Griswold stated that more information is needed since one of the parcels may be under contract.

Selectman Bice stated that at the last meeting of the Task Force, Linda Krause presented information about the review of the Zoning ordinances.  The ordinances regarding the flood zone allow one improvement of properties in the lifetime of the property which she observed as highly restrictive and recommended the town alter that.  The non-conforming properties have similar restrictions, which prohibit any form of modification.  She is going to provide recommended language to be review by the Board of Selectmen to be taken before the Zoning Commission.

e.  Sound View Parking Committee – Update
The next meeting will be on October 18, 2002 at 8:00 A.M.  

f.  I-95 Feasibility Study - Update   
Consultants for the DOT visited the Old Lyme Town Hall on September 17, 2002 and talked about the I-95 Branford to Rhode Island feasibility study.  Closed caption TV, electronic variable messages and highway advisory radio would be involved.  Construction would start in September 2003.  Resurfacing is contemplated from Old Lyme to the Waterford-New London area involving milling and replacing the pavement. Construction will begin in Mar 2004 for a two-year duration. More information will follow.

5.  New Business:
a.  Library Lane Residents’ Petition
The Board has received a petition from a number of residents of Library Lane expressing concern about the traffic conditions at the end of Library Lane and Lyme Street, especially when school lets out.  Safety has been greatly compromised by the limited Lyme Street parking for parents and many are picking up children at the library.  The traffic is congested and visibility is poor.  They are suggesting the town add a cross walk, blinking lights, and widening Library Lane.  First Selectman Griswold said he will look into this situation.

b.  Special Voter Registration Sessions – Pat McCarthy
The Democratic Registrar of Voters Pat McCarthy spoke about a special voter making session on Saturday, October 19, 2002 from 10:00 A.M. until 2:00 P.M. at Cross Lane Firehouse.  The second voter making session will be on Tuesday, October 22, 2002 in the Old Lyme Town Hall until 8:00 P.M.  On Monday, October 21, 2002 the Registrars will go to the high school and will register 17 and 18 years old voters.  

c.  Johannesburg Central Methodist Choir Proclamation
Last week 53 members of the Central Methodist Choir of Johannesburg, South Africa sponsored by the Congregational Church sang their National Anthem at the Old Lyme Town Hall and then proceeded to the school.  The Selectmen read a proclamation welcoming and congratulating them on using the proceeds of their tour to establish day care centers for people with HIV in their community.  All the members have been staying at area households.  

d.  White Cane Safety Day – October 15, 2002
The National Federation of the Blind of Connecticut has identified October 15, 2002 as White Cane Safety Day.  

6.  Public Comment
Open Space Chairman George James stated that Bob Roser, who is president of the Black Hall Club, requested that the Black Hall Club have a conservation easement placed upon it as an open space area to avoid adding houses around the perimeter.  Mr. Roser has drawn up a legal document pledging not to have any residential development on the golf course for the next 10 years at which time it could be renewed.

First Selectman Griswold reported that CL&P has issued two grants to Regional District #18.  One grant is in the amount of $11,252 and the other for $12,577.  If the school purchases more energy efficient electrical equipment, CL&P will reimburse the school the difference between the lesser more energy consumptive units and the more energy efficient ones.

Selectman Bice made a motion to adjourn at 5:25 P.M.  The motion was seconded by Selectman Sibley.  SO VOTED.
